Legal Aspects

In Germany the sales process is not overseen by two solicitors, as is the case in the UK and Ireland. Instead the transaction is overseen by a Notary Public, who ensures that all legal and financial obligations are met. All contracts have to be signed in front of the notary, but the purchaser may give power of attorney to a lawyer or estate agent to sign on their behalf.

In addition the buyer may wish to seek the advice of other professionals such as a lawyer or architect. A lawyer will be able to check the status of the property with the land registry, check the rents and rental contracts and establish whether there are any outstanding loans on the property.
